LOCATION OF DEBTORS

DEBTOR WATCH REGISTER

If you use Veda or other credit reporting agency reports you may wish to consider using our Debtor Watch Register

The Debtor Watch Register monitors court listings, electoral rolls and selected social media and career networking sites.

Court listings can identify pending court cases for debtors which may identify their current legal representation, allow the debtors to be served with legal documents on the day of the court or assist with a security vehicle being located in the vicinity of the court on that day.

Veda and other credit reporting agencies will indicate where there is a judgment for a civil matter but do not indicate pending civil or criminal court dates nor do they monitor social media or career networking sites.

In cases of Bankruptcy in particular where the Trustee in Bankruptcy is the Australian Financial Security Authority (AFSA) some additional scrutiny of the debtors Statement of Affairs may be desired.

Asset Search Pty Ltd can conduct a further limited investigation beyond that already conducted by AFSA with a view of locating any assets that may have not been identified.

Third party possession of security vehicles is a huge problem in the finance industry.
In many cases firms will sell existing debt when security vehicles have not been recovered.
It is possible to recover those vehicles and auction them to obtain a more realistic return.

Selling doubtful debt makes sense but selling off debt where recovery can be obtained is bad business. Selling debt does mitigate losses but the truth is that selling debt is in itself is a loss.

FRAUDULENT CONTRACTS

If you have a debt that has been incurred due to false information being supplied on an application for finance an offence of obtaining a financial advantage by deception or obtaining property by deception may have been committed.

In such cases you may wish to report these matters to police which may cause a security vehicle to be recovered by police. In Victoria in the circumstances where a company has been a victim of a crime of dishonesty for an amount of over $10,000 or more the police can apply for an order for the confiscation of assets from an offender and subsequently seize and sell the assets to that value for restitution.

In some circumstances you may notice a trend of contracts becoming delinquent by debtors of the same ethnicity, geographical location or other common denominator which may indicate that your company has been targeted by a criminal syndicate.

Asset Search Pty Ltd has conducted investigations on behalf of the banking industry where syndicated fraud has been suspected. Our company has identified offenders, their modus operandi and an analytical report has been compiled and presented to police to initiate their investigations.
